This paper discusses child custody law in the Republic of Ireland
Abstract:
The article discusses child custody law in the Republic of Ireland. As the primary source of rights in the family law arena is identified as Ireland's Constitution, the first section of the article discusses the constitutional definition of the family and the Constitution's position on the rights and duties of parents in relation to their children. The second section of the article discusses the legislative position vis-a-vis custody rights (including marital and nonmarital), custody orders, and the process of custody adjudication, and vis-a-vis substantive norms in custody determinations (such as the welfare of the child and determination of the child's best interests). Custody rights and the right to relocate are also discussed. The third and final section explains Ireland's ratification of international instruments to facilitate the recognition of custody and access decrees from other nations, including the Hague Child Abduction and Luxembourg Conventions.
